Rep. Kahl CBD Oil Extract Bill Passes State Assembly on Voice Vote

(Monona) – Assembly Bill 726, authored by State Representative Robb Kahl (D-Monona), passed the Assembly today on a strong, bi-partisan voice vote.  The bill will allow Wisconsin parents of children with seizure disorders to work with physicians to have access to an effective treatment in the form of cannabidiol, otherwise known as CBD Oil Extract.

“I want to thank all of the members of the Assembly,” Kahl stated.   “Every one of the members approached this issue with an open mind, listened to the testimony provided and then voted in accordance with their personal views.  In my opinion, the manner in which members of both parties have found common ground in trying to respond to the parents of children with seizure disorders has provided our Assembly with one of its finest hours.”

“I also want to again thank the members of the Wisconsin Medical Society for their support of this bill,” Kahl added.   “I have faith in the ability of Wisconsin physicians to assess patient needs and then determine if treatment with CBD Oil Extract is an appropriate option for their patients and I am very pleased Wisconsin physicians have endorsed this bill.”

“Under current Wisconsin law, parents of children with seizure disorders in Wisconsin cannot work with physicians to try this treatment option,” Kahl added.   “Instead, they are limited to trying medications that are often ineffective and have negative side effects.  Some parents are compelled to have their children placed in medically induced comas or are forced to consider brain surgeries that may or may not be effective in treating the seizures.  There is no legitimate reason to force a parent to choose brain surgery for their child when a legitimate noninvasive treatment option is left untried.”

“Parents of children with seizure disorders in other states have seen remarkable results after treating their children with CBD Oil Extract,” Kahl noted. “It is derived from a strain of marijuana plant that has no value other than in the production of CBD Oil Extract, it does not have psychoactive or hallucinogenic properties.  Scientists believe that CBD quiets the excessive electrical and chemical activity in the brain that causes seizures – which can be fatal.”

“I believe that parents of children with seizure disorders are best able to determine the course of treatment for their child.   One option they want, with the approval of their child’s physician, is to be able to use CBD Oil Extract to treat their child,” Kahl concluded.  “This bill, if passed, will provide Wisconsin parents who are struggling to find ways to improve their child’s health or to simply enable their children to live, with hope that another treatment option will be available to them.”

The bill makes it clear, under state law, the cannabidiol, is not THC and a schedule 1 drug, if a physician dispenses it or provides a letter authorizing use for the treatment of a seizure disorder.  In addition, it provides that cannabidiol may be possessed for treatment of a seizure disorder if dispensed by a physician or if the physician provides a letter stating the individual possesses it to treat a seizure disorder.  As amended it will also require the Wisconsin Controlled Substances Board to work with physicians to obtain the necessary investigational drug permits from the Food and Drug Administration (FDA).   Once FDA approval is granted, the Controlled Substances Board would then be able to designate pharmacies and physicians who could dispense the medication and allow it to be transported to Wisconsin in accordance with federal law.

“CDB Oil Extract will not be dispensed in Wisconsin without approval by the FDA,” Kahl noted.  “Opponents of this bill had stated they needed the FDA approval to move forward.   The action in the Assembly today moves the bill to the State Senate.   It is time to move this bill forward for Wisconsin families.”
